Clipick is a short-video app: people post clips, other people guess what happens before a reveal, and everyone can like, comment, follow, and react to what they see. These Terms govern anyone who uses Clipick — viewing, posting, commenting, or otherwise. If you upload a clip specifically as a prediction round, the separate Creator Content & DMCA Policy also applies to that submission and controls where the two documents overlap.
Clipick does not involve real money. There are no purchases, no prizes, no cash payouts, and no monetary value attached to guessing correctly or incorrectly anywhere in the app. Guessing is for entertainment only.
Part One — Using Clipick
1.1Eligibility & Age
Clipick is not directed at children under 13, and we do not knowingly collect personal information from anyone under 13. The minimum age to create an account is 13.
By creating an account, you also confirm you have the legal capacity to agree to these Terms where you live.
1.2Your Account
You're responsible for the accuracy of the information you give us, for keeping your login credentials secure, and for everything that happens under your account. Tell us right away if you suspect unauthorized use, at support@clipickapp.com.
Clipick allows multiple accounts per person.
1.3No Real Money, No Prizes
Nothing in Clipick can be purchased, redeemed, cashed out, or exchanged for money or anything of value. Correctly guessing an outcome has no monetary consequence — there is no leaderboard payout, no prize pool, and no in-app currency that converts to real value. Any in-app credit, badge, streak, or similar feature that may exist is purely cosmetic and has no cash value, is non-transferable, and confers no rights outside the app.
1.4Acceptable Use
You agree not to do any of the following on Clipick:
Post content that's illegal, hateful, sexually explicit, or that depicts real harm to a person or animal.
Harass, bully, threaten, or dox another user.
Impersonate another person or misrepresent your affiliation with anyone.
Post content you don't have the rights to, or that infringes someone else's intellectual property (see the Creator Content & DMCA Policy for the full rules on submitted clips).
Spam, scrape, or use automated tools to access or collect data from Clipick without our written permission.
Stage content in a way that materially misleads viewers about whether it's real — a fabricated "gotcha" undermines the guessing format for everyone.
Try to circumvent moderation, age restrictions, account bans, or other safety measures.
1.5Content You Post
You keep ownership of anything you post. By posting, you grant Clipick a non-exclusive, worldwide, royalty-free license to host, display, distribute, and (where relevant to how the app works) trim or edit your content within the app, and to use short excerpts to promote Clipick. This license lasts as long as your content is active on Clipick and ends when you delete it or your account, except for promotional material already published before that point. If you submit a clip specifically as a prediction round, the Creator Content & DMCA Policy's fuller warranties and license terms apply to that submission in addition to this section.
1.6Reporting, Blocking & Enforcement
Clipick provides in-app tools to report content or accounts you believe violate these Terms, and to block other users. We review reports and may remove content, restrict features, or suspend or terminate accounts that violate these Terms, at our discretion and without always giving advance notice — particularly where we believe there's a safety issue. Removal or enforcement doesn't necessarily mean we've concluded you did something wrong; sometimes we act on limited information to protect other users while we investigate further.
Part Two — Legal Terms
2.1Intellectual Property
The Clipick name, logo, app design, and underlying software are owned by Clipick (or its licensors) and are not covered by the content license in Section 1.5. Nothing in these Terms gives you rights to Clipick's own branding or technology beyond what's needed to use the app normally.
2.2Copyright & DMCA
If you believe content on Clipick infringes your copyright, see the notice-and-takedown process in the Creator Content & DMCA Policy, which governs copyright claims for both submitted prediction clips and other user content.
2.3Disclaimers
Clipick is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, reliability, or uninterrupted availability. We don't guarantee that any particular content, feature, or account will remain available.
2.4Limitation of Liability
To the maximum extent permitted by law, Clipick is not liable for indirect, incidental, special, or consequential damages arising from your use of the app. Clipick's total liability for any claim relating to the app is capped at $100, or the amount you paid Clipick in the past 12 months, whichever is greater — which today means the cap is $100, since Clipick charges nothing.
2.5Indemnification
You agree to indemnify and hold Clipick harmless from claims, losses, or expenses (including reasonable attorney's fees) arising from your breach of these Terms or your content's infringement of a third party's rights.
2.6Dispute Resolution
Clipick includes mandatory arbitration and a class-action waiver. Any dispute arising from these Terms or your use of Clipick will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, and you agree to bring claims only in your individual capacity, not as part of a class, consolidated, or representative action.
You may opt out of this arbitration agreement by emailing support@clipickapp.com with your name and username within 30 days of creating your Clipick account, stating that you opt out of arbitration. Opting out does not affect any other part of these Terms.
2.7Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
2.8Changes to These Terms
We may update these Terms as Clipick changes. We'll post the updated version with a new effective date; continuing to use Clipick after changes take effect means you accept them.
2.9Termination
You can stop using Clipick and delete your account at any time. We can suspend or terminate your access for violating these Terms, or for any other reason with reasonable notice where practical. Sections that by their nature should survive termination (ownership, indemnification, dispute resolution) continue to apply.
